General information

The following conditions apply to all offers and all contracts. Deviations are only valid if they have been expressly acknowledged in writing. Oral statements made by representatives and employees of the seller must be confirmed in writing to be valid. Offers and orders are subject to change without notice until order confirmation and/or invoice. This also applies to orders placed with representatives of the seller.
Telephone, written and oral orders are only accepted by persons capable of acting. In the case of minors or persons under guardianship, the consent of the legal guardian is required. The purchaser accepts these terms and conditions without reservation for every order placed by telephone, verbally, electronically or in writing.
Otherwise, the Swiss Code of Obligations (OR) shall apply.

Prices

The indicated prices are cash sales prices including VAT plus shipping costs in Swiss Francs. Prices are subject to change and errors excepted.

Delivery

The goods are usually sent by mail or courier at economy rate. On request and for an additional charge, shipments can be insured and/or shipped with priority. Transport damage must be reported to the responsible carrier within 7 days of receipt. Not collected or not accepted devices will be reminded with a reminder fee of CHF 20. Each further reminder will be charged with an additional CHF 20. Any costs incurred as a result will be charged to the orderer/purchaser.

Delivery abroad

In principle we only deliver abroad against prepayment. Postage and packaging costs are subject to prior agreement.

Warranty

The seller gives the original warranty of the manufacturer on all devices and goods, but at least 6 months. Within this warranty period, the seller bears the costs for spare parts and the working time required for repair. The buyer is obliged to bear the costs of return shipment to the seller. The costs of reshipment to the buyer together with insurance shall be borne by the seller. Complaints must be reported to the seller in writing within 7 days. The date of the postmark is decisive. Complaints cannot be processed after this period. Unsubstantiated and unagreed returns are at the expense of the buyer. Returns will only be considered if the goods are returned in the unchanged original packaging. Returns by cash on delivery are generally not accepted. Minor deviations of the articles in shape, colour, size or design are no reason for complaint. If the buyer wants to exchange an item, a deduction can be claimed depending on the condition. Returned articles are compensated with a credit note.
The warranty covers material defects. Overloading and/or consequential damages are not included in the guarantee. Repair equipment must always be delivered or returned with a written description of the damage. They must also be adequately stamped and appropriately packaged to protect the goods. The invoice is regarded as the warranty certificate and must be presented in the event of a warranty claim. Equipment for repair must be returned in its original packaging to i-audiopoint Nisco Audio and Digital Signage International Solutions GmbH. If the original packaging is no longer available, a packaging fee of CHF 20 may be charged.

Compensation

No liability is assumed for damages that have occurred for the following reasons: Unsuitable or improper use, faulty assembly or commissioning by the client or third parties, natural wear and tear, faulty or negligent handling, construction errors and software faults, unless they are due to the fault of the seller, or errors that are due to improper operation, incorrect wiring or mechanical damage or that are caused by repair attempts by technicians not authorised by the seller.
Claims for damages are limited to the value of the delivered goods. Claims for damages of any kind against the seller due to violation of secondary contractual obligations, from fault at the time of conclusion of the contract or from tort are excluded, unless there is intent or gross negligence.

Rental or demo equipment

In case of rental, the equipment will be checked by Us before shipment, but it can happen that something is no longer functional due to transport, for this reason the Lessee is obliged to check everything immediately upon receipt of the equipment and to send the enclosed form to Us by e-mail or by post, this must be done immediately after receipt of the equipment, any liability thereafter is fully at the expense of the Lessee.
If the rental period is not respected as agreed, the full amount of the rental will be charged from the following day, even if special prices have been negotiated before.
The goods must always be returned in the original box and with all accessories, the missing accessories as well as any damage to material or packaging will be fully charged.
The rental period is calculated from the date of shipment and ends when the goods are received in full.

Return of goods

The delivered goods will only be taken back if this has been previously agreed, the goods and the original packaging are in perfect condition and the return is carriage paid to the seller’s place of business. The seller reserves the right to refuse acceptance of goods returned without agreement. For returned goods or goods taken back due to the reservation of title, the current value will be credited with deduction of a handling fee, unless the return was not made due to a justified complaint. If a 10-day right of return has been agreed, the buyer shall bear the costs for the outward and return shipment.

Payment

The payment is made by prepayment to our bank account.
Retention of title
Until the full purchase price has been paid, the goods shall remain the property of i-audiopoint NIsco Audio and Digital Signage International Solutions GmbH and may not be sold or modified.

Liability

The devices may only be operated by qualified personnel and only via safety current switches. No liability is accepted for damage caused by improper installation or use.

Place of performance, legal venue

The place of performance for all services arising from the contractual relationship is Galgenen as the business location of i-audiopoint Nisco Audio and Digital Signage International Solutions GmbH. The place of jurisdiction for all disputes arising from this contractual relationship – including withdrawal – is Lachen SZ, regardless of the value in dispute.
